Terms and Conditions of Use (TCU) – Makiti SARL

Welcome to the Makiti SARL platform. By accessing our digital services, applications or websites, you unreservedly accept these Terms and Conditions of Use (TCU). Please read them carefully before use.

1. Presentation of Makiti SARL

Makiti SARL is a company incorporated under Cameroonian law, registered in the Trade and Personal Property Credit Register (RCCM) under number M052318275229B, with its registered office located in Yaoundé-Santa Barbara, opposite Sonel. The company develops and provides digital solutions designed to facilitate access to products and services.

2. Definitions

In these Terms of Use, the terms below have the following meanings :

  • “User” : any natural or legal person using the digital services offered by Makiti SARL.
  • “Services” : all features accessible via the websites, applications or interfaces made available by Makiti.
  • “Content” : any data, information, text, image, sound, video or element made available via the services.
  • “User account” : a personal and secure space created by a user to access certain services.

3. Purpose of the T&Cs

The purpose of these T&Cs is to define the terms and conditions of access, use and operation of the digital services provided by Makiti SARL.

4. Access to services

Access to the services is open to anyone with an Internet connection. Certain features may require the prior creation of a user account or secure authentication

The user undertakes to :

  • Provide accurate, complete and up-to-date information when registering.
  • Keep their login details confidential.
  • Immediately inform Makiti SARL in the event of fraudulent use of their account.

5. Responsible use of services

The user agrees to :

  • Use the services in accordance with the laws and regulations in force in Cameroon, in particular Law No. 2010/012 of 21 December 2010 on cybersecurity and cybercrime, as well as the principles of the GDPR for users located in the European Union.
  • Not publish content that is illegal, harmful, violent, abusive, defamatory or infringes on the rights of third parties.
  • Refrain from any attempt to intrude or compromise the integrity of the platform (hacking, exploitation of vulnerabilities, etc.).
  • Not misuse the services for commercial purposes not authorised by Makiti SARL.

6. Intellectual Property

All elements constituting the platforms, services and content distributed by Makiti SARL (text, graphics, logos, software, interfaces, codes, etc.) are protected by intellectual property laws.

Any unauthorised reproduction, representation, distribution or use is strictly prohibited without the prior written consent of Makiti SARL.

7. Protection of personal data

Makiti SARL is committed to respecting the privacy of its users. Personal data collected is processed in accordance with Cameroonian law (Law No. 2010/012) and, where applicable, the GDPR for European users.

8. Availability and maintenance

Makiti SARL strives to ensure continuous availability of services. However, it cannot be held responsible for interruptions due to :

  • Scheduled maintenance operations.
  • A technical failure beyond its control.
  • Force majeure (network outage, natural disaster, etc.).

9. Limitation of liability

Makiti SARL cannot be held liable for any direct or indirect damage resulting from the use or inability to use the services, including but not limited to

  • Loss of data.
  • Technical malfunctions.
  • Content published by third-party users.

The user remains solely responsible for their comments, publications and activities on the platform.

10. Suspension and termination

Makiti SARL reserves the right to temporarily or permanently suspend a user's access to the services, without notice, in the event of a breach of these Terms of Use or behaviour that is harmful to the platform or other users.

11. Changes to the Terms of Use

Makiti SARL reserves the right to modify these Terms of Use at any time. Any changes will be updated on the platform.

Continued use of the services after publication constitutes acceptance of the new terms.

12. Applicable law and jurisdiction

These Terms of Use are governed by Cameroonian law.

In the event of a dispute, the parties will endeavour to resolve the dispute amicably. Failing this, the competent courts of the jurisdiction of Makiti SARL's registered office (Yaoundé) shall have sole jurisdiction, unless otherwise provided by law.
